The land in question is classified in relation to the PDM as an Urban Space, inserted in an urban expansion area of ​​general use, in the subcategory of land use of Urban Expansion Areas of Housing Typology, identified in paragraph b) of article 69º of the PDM Regulation
Mobility and Transport Charter
The plot of land is affected, in the southeast area, by a route corresponding to the Axis Concelhio Complementar Proposto, to connect the junction between Rua da Saibreira, Rua do Cruzeiro, Rua de São Vicente and Rua de Lavadores, existing to the northeast, with Travessa de Lavadores (adjoining the land to the southwest).
Under the terms of the Municipal Master Plan Regulation, and according to the classification in Areas of Urban Expansion of Housing Typology, the regulatory provisions contained in its articles 70,74, 75 and 76 are applicable, as well as the regulatory provisions of the General Use Urban Expansion Areas contained in articles 69 and 70 of the same regulation. In view of the provisions of points 1 and 2 of article 70 (buildability) of the PDM Regulation, in Urban Expansion Areas of Housing Typology, where the land is inserted, only buildings or subdivision operations under detail or execution units, with the exception of buildings that are adjacent to the urbanized area, facing a properly infrastructured public street, or with areas that have acquired characteristics similar to that through building actions, where individual operations may be authorized, as the provisions of point 2 of article 139.
In accordance with the provisions of article 36 (alignments) of the PDM Regulation, the implantation of the buildings to be implemented on the land must respect the dominant alignment defined by the existing buildings in the street on which the claim is based, consolidating the built front along the of said route.
The new main constructions to be implemented on the site must be located within a 35 m strip, bordering the public space, as established in point 1 of article 42 (implementation) of the PDM Regulation, except, and provided that they are urbanistically well-founded, equipment, detached houses on four fronts, commerce and services, buildings that are intended to fill an expectant gable of a legal building, in accordance with the provisions of point 2 of the same article. In accordance with point 3 of the same article, without prejudice to the provisions of article 39 (new streets), buildings that may constitute a second line of individual construction are not allowed.
With regard to uses, it determines the provisions of points 1,2 and 3 of article 75 (uses) of the PDM regulation, which 3 / 3 of. obp. 52.01 in Areas of Urban Expansion of Housing Typology, the dominant use is housing, the complementary uses and activities allowed are the equipment, and other uses are also admitted as compatible uses provided they do not contradict the provisions of article 12 (criteria of viability of land uses) of the same regulation. - Article 76 (buildability) of the PDM regulation establishes that the admissible architectural typologies in the Urban Expansion Areas of Housing Typology are detached, semi-detached or semi-detached single or two-family houses, with or without a common basement, the maximum height of 2 floors, admitting a third floor with a gross area equivalent to 50% of the area of ​​the floor immediately below
